Welcome to Deposit a Dream. These Terms of Service ("Terms") govern your access to and use of the Deposit a Dream website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, depositing a dream, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Deposit a Dream is a platform that allows users to record, process, and explore their dreams. Users can purchase "Sparks" (our digital credits) to unlock various enhancements for their deposited dreams, such as illustrations, video generation, structural editing, and deep readings.
3. User Accounts and Content
You must maintain the security of your account and are responsible for all activities that occur under your account. You retain all ownership rights to the dream content you submit. However, by submitting content, you grant Deposit a Dream a worldwide, non-exclusive, royalty-free license to use, process, and display the content solely for the purpose of providing the Service. You agree not to submit unlawful, abusive, harassing, or copyright-infringing material. We reserve the right to suspend or terminate accounts that violate our content policies.
4. Purchases and Merchant of Record
Our order process is conducted by our online reseller, Polar (Polar Software Inc.). Polar is the Merchant of Record for all our orders. They provide all customer service inquiries and handle returns according to their policies. When you purchase Sparks or a subscription, your payment is processed securely through Polar, and you agree to their respective terms and conditions regarding payment processing.
5. Sparks and Billing
"Sparks" are digital credits used within the Service to access premium features. Sparks are consumed when you deposit or upgrade dreams based on the specific enhancements you select. All purchases of Sparks are final and non-refundable, except where required by law or specified by our Merchant of Record, Polar. Sparks have no real-world monetary value and cannot be exchanged for cash.
6. Artificial Intelligence and Generated Content
Deposit a Dream utilizes artificial intelligence (AI) to generate text, images, and video based on your submitted dreams. Due to the nature of AI, the generated output may occasionally be unpredictable or inaccurate. You understand and agree that the generated content is provided "as is" and we make no guarantees regarding its quality, accuracy, or fitness for a particular purpose.
7. Privacy and Data Usage
Your privacy is important to us. Dreams deposited privately remain visible only to you. If you choose to make a dream public, it may appear on our Explore page and be discoverable by other users. 8. Intellectual Property
The Service and its original content, features, and functionality are owned by Deposit a Dream and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Deposit a Dream shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Modifications to the Service and Terms
We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also revise these Terms from time to time. The most current version will always be posted on our website. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
